This Privacy Policy (“Privacy Policy”) is designed to help you understand how Fairfield OpCo LLC d/b/a Objective Management Group, Inc. (collectively “OMG”, “we”, “our,” or “us”) collects and uses the information, including Personal Data, that ayou share with us when you use https://www.objectivemanagement.com and any other website operated by OMG (each a “Site”), that you provide in connection with the OMG Offering or other Services, as defined below, or otherwise provide to OMG. Except where otherwise expressly indicated in this Privacy Policy or on the Site, this Privacy Policy applies only to information collected on the Site and through the Services. It also describes the choices available to you regarding our use of your Personal Data and how you can access and update this information.

Before submitting information to the Site or Services or otherwise using the Services, please review this Privacy Policy carefully. BY USING OR ACCESSING THE SITE OR SERVICES AND/OR COMMUNICATING WITH OMG VIA MAIL, EMAIL, OR TELEPHONE, YOU INDICATE YOUR UNDERSTANDING AND ACCEPTANCE OF THE TERMS OF THIS PRIVACY POLICY. You are responsible for submitting accurate information to us. If you prefer that we not collect your Personal Data, please do not provide it to us. WHEN YOU SUBMIT YOUR PERSONAL AND OTHER INFORMATION ON THE SITE OR THROUGH YOUR USE OF THE SERVICES, YOU HEREBY CONSENT TO THE COLLECTION, USE, AND DISCLOSURE OF SUCH INFORMATION AS SET FORTH IN THIS PRIVACY POLICY. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE SITE OR SERVICES.

Please carefully read this Privacy Policy as it may have changed since your last visit to the Site. Continued use of the Site or Services indicates your understanding and acceptance of any changes made to this Privacy Policy and posted to the Site. This Privacy Policy does not cover the privacy practices of any third-party websites to which the Site or the Services may link.

Definitions

“Personal Data” has the meaning set forth in Section 4.A. below.

Services” refers to the products and services made available by OMG, including but not limited to the OMG Offering, and other services that are offered pursuant to a separate written agreement.

OMG Offering or “Offeringmeans the platform and proprietary assessment tools designed to evaluate individual competencies, behavioral traits, and job fit across various roles, including those in sales, leadership, and operations.

Site Visitor” means any person who uses the Sites, which includes browsing the Sites or submitting any information to OMG through a Site.

Customer” means an individual or entity that has entered into an agreement with OMG to purchase and use any of the Services.

Reseller” means an organization through which a Customer purchased the Services.

 

Data Storage

OMG is headquartered in the United States and may have operations and service providers in the United States and around the world. All data is stored on servers located in the United States, and most processing of data occurs within the United States. In some cases, we may use service providers or subcontractors that process data on our behalf in other locations, consistent with this Privacy Policy. The Site and Services are governed by United States law. If you are outside the United States when you visit the Site, use the Services or engage in communications with an OMG agent via mail, e-mail or telephone, please be aware that you consent to our use and our service providers’ use of your Personal Data worldwide and to the transfer of your Personal Data to countries outside of your country of residence, including the United States. Please be aware that the US and jurisdictions other than the one in which you are located may have a lower standard of data protection laws compared to your own jurisdiction. In certain circumstances, courts, regulatory agencies, law enforcement agencies, or security authorities in those other countries may be entitled to access your Personal Data.

 

Information We Collect

We collect the information that you share with us, including:

  1. Personal Data

Personal Data” as it is called in some countries, is information that reasonably can be used to personally identify you (the “Data Subject”). We maintain one or more databases in the United States to store your Personal Data and may retain it as reasonably required to fulfill the purposes identified herein. Personal Data that we collect depends on how you use the Site or Services.

We may collect your Personal Data when you:

  • register to use or use any of the Services, including when an organization contracts for you to complete an assessment (such as a Customer (who may be your employer or potential employer) or a Reseller);
  • subscribe to our newsletter;
  • complete an online assessment;
  • contact OMG by any means, including but not limited to filling out a form or using information available on the Site;
  • request information or materials;
  • purchase a Service;
  • request support for the OMG Offering;
  • submit a job or advisory board application; or
  • submit any information to OMG.

We may collect the following types of Personal Data:

  • your first and last name;
  • email address;
  • mailing address;
  • phone number;
  • responses to online assessment questions; and
  • any other identifier that permits OMG to make physical or online contact with you.

  • operating system information;
  • usage data;
  • browser information;
  • IP address; and
  • date, time, length of stay, and specific pages accessed during your visits to the Site or use the OMG Offering.

B. General Information

When you visit the Site or use the Services, we may collect various categories of general non-personal information (“General Information”). When possible, General Information may be linked to Personal Data. We do this to improve the Services we offer you, and for purposes of our analytics. You may visit the informational areas of our Site anonymously; however, assessment services may not be used anonymously.

D. Widgets

Our Site may include features such as the (i) Facebook Like button (“Social Media Features”) and (ii) Share this button or interactive mini programs that run on our Site (“Widgets”). These features may collect your IP address, which page you are visiting on our Site, and may set a cookie to enable the feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy policy of the company providing it.

E. Assessment Data

Please be aware that our assessment services have been contracted in order to protect the legitimate interests of the data controller – a Customer who has determined that it is necessary to understand and/or confirm the sales and/or leadership capabilities of its employees or candidates for employment.

All data submitted via our online assessments will be shared with the Customer who purchased our Services and the Reseller through whom those Services were purchased. The Customer and Reseller may have separate and independent privacy policies. We therefore have no responsibility or liability for the activities of Customers and Resellers.

During the course of providing assessment services via our Site, we collect information including:

● Contact information, including name. This is used by our Customers to identify your responses to the assessment.

● Information about your experience in a specific company, type of job, or industry.

● Device data, including your IP address, operating system, device type, and web browser type. This is used for technical support and traceability.

● Your email address. This is used to contact you about the status of your assessment and is shared with Customers to identify your responses or contact you.

Your Personal Data will be shared with the Customer and, where applicable, the Reseller, and may also be shared with trusted service providers identified in Section 6 who assist us in operating our Site and providing the Services (for example, hosting, security, or customer support) and where required by law.

The data from your assessment, stripped of Personal Data and aggregated with other such information, may be used by OMG for research purposes and to improve our Services.

The questions and options that make up our online assessment questionnaires are intellectual property owned by OMG and cannot be copied, saved, or reproduced without our express written permission.

Your assessment questionnaire responses are owned by the Customer who purchased the Services. Please contact the Customer directly for any concerns about your assessment results.

If you have completed an assessment with OMG within the past year, we reserve the right, at our discretion, to reuse your previously-provided answers as a substitute for asking you the same questions again. Doing this saves you the time and frustration of answering questions you have already answered and also preserves the integrity of our assessment by minimizing opportunities for a respondent to provide conflicting answers. Note that only multiple-choice answers, and never your Personal Data (such as your name and email address), will be copied from a previous assessment to a current assessment. This reuse applies only to assessment responses and does not change the Customer’s ownership of assessment results or your ability to request access or correction as described below.

Please contact the Customer who purchased OMG's Services to access or correct assessment-related Personal Data. Where appropriate, OMG will assist the Customer in responding to such requests consistent with our contractual obligations.

F. Marketing Data

When you request information from our Site by downloading a white paper or report, using one of our online tools, or completing an information request form, we will share the contact information you provide with one of our Business Partners so they can contact you to discuss your request. Business Partners may have their own privacy practices and may act as independent controllers of the information they receive for their follow-up communications. Please contact OMG to access or correct the marketing data you provide to us or to request the removal of this data from our systems.

5. How We Use Personal Information

Except as specified in this Privacy Policy, OMG does not rent, sell, trade, or disclose your Personal Data to third parties without your informed prior consent. However, General Data or de-identified or aggregated visitor information (that does not reasonably identify you) may be provided to other parties for analytics, marketing, advertising, or other business purposes.

Some specific examples of how OMG may use your Personal Data are:

  1. to provide and administer the Services (i.e., providing the online assessments and assessment services to you and the Customer, including providing assessment-related outputs to the Customer);
  2. to customize, analyze, adjust, and improve the Site and Services to better meet your needs;
  3. to facilitate communication between OMG and you;
  4. to provide you with information that may interest you, such as our newsletters or emails about our products and Services (this information contains a subscriber link allowing you to opt out);
  5. to provide you with marketing and promotional information about products and Services we believe may interest you (this information contains a subscriber link allowing you to opt out);
  6. to administer a survey (if you consent to participate in the survey via a response email);
  7. in a Customer testimonial posted on the Site;
  8. to enforce OMG’s agreements with you;
  9. to provide you with important administrative information regarding the Site and Services, such as changes to this Privacy Policy, our Terms of Use, and our other policies;
  10. and to prevent fraud and other prohibited or illegal activities.

6. Disclosure Of Information That We Collect

Unless you have consented or as otherwise described in this Privacy Policy, we will not disclose your Personal Data except for:

A. Business Partners. We may share your information with our business partners, including Customers and Resellers. OMG does not control our business partners’ use of the information, and their use of the information would be in accordance with their own privacy policies.

B. Advisors. We may share your information with our contracted advisors or agents, such as accountants, attorneys, or consultants, in order to operate our business and provide the Services.

C. Fulfillment of Services. OMG may retain other companies and individuals to perform functions consistent with our Privacy Policy on our behalf (“Subprocessors” or “Subcontractors”). Examples include Customer support specialists, web hosting companies, fulfillment companies (e.g., companies that fill product orders or coordinate mailings), data analysis firms, payment services firms, and email service providers. Such third parties may be provided with access to Personal Data needed to perform their functions but may not use such information for any other purpose and shall abide by practices consistent with this Privacy Policy.

D. Compliance with Law and Fraud Protection. We may disclose any information, including, without limitation, Personal Data, we deem necessary, in our sole discretion and without your prior permission, to comply with any applicable law, such as to comply with a subpoena, regulation, binding orders of a data protection agency, legal process or governmental request. We also may be required to disclose an individual’s Personal Data in response to a lawful request by public authorities, including to meet national security or law enforcement requirements. OMG reserves the right to disclose your Personal Data if we believe you have or are violating our Terms of Use or in order to protect or defend OMG’s rights or property, even without a subpoena, warrant or other court order. We also may access or disclose your Personal Data to act in urgent circumstances to protect the personal safety of users of the Services or members of the public.

E. Sale or Transfer of Information. In the event of a sale, merger, liquidation, dissolution, or sale or transfer of substantially all of the assets of OMG or the OMG Offering to an Affiliate or a third party, Personal Data or other information collected through the Site or the Services may be sold, assigned or transferred to such affiliate or third party. In the unlikely event of insolvency, bankruptcy, or receivership, your information also may be transferred as a business asset. By using the Site and Services and submitting your information to us, you consent to the sale and transfer of your information as described in this paragraph. You will be notified via email and/or a prominent notice on our Site or the OMG Offering, of any change in ownership or uses of your Personal Data, as well as any choices you may have regarding your Personal Data.

F. Frames. Some of our pages utilize framing techniques to serve content to from our partners while preserving the look and feel of our Site and Services. Please be aware that you are providing your Personal Data to these third parties and not to us directly.

G. Third-Party Links. The Site or Services may allow you to connect with other websites, products, or services that we do not control. We are not responsible for the information collection practices of any website that we do not own or control. If you visit or use such services, we recommend that you review and understand their privacy practices before sharing your information with those services.

7. Your Rights and Controlling Your Personal Information

A. Your Rights

While OMG does not have a business location within the European Union (“EU”) or European Economic Area (“EEA”) or directly market or sell to EU or EEA individuals or businesses, in some cases we serve as a processor or sub-processor of Personal Data for data controllers located in the EU or EEA and are committed to respecting your applicable rights as they pertain to such Personal Data.

Please note that your rights must also be balanced with the rights of other parties, including the Customers which contract our assessment services. This includes, for example, those parties protecting their legitimate interests as they pertain to understanding your strengths and weaknesses which are measured by our assessments.

Your rights may include the following:

Right of Access - Upon request, we will confirm the personal information we hold about you. Please note that our questionnaires are our copyrighted intellectual property, and are not considered part of your Personal Data.

Right to Rectification - Upon request, we will rectify any incorrect "demographics" we hold about you. This would include, for example, your name and email address. In most cases, your information is processed immediately upon its submission and passed on to the Customer which contracted our assessment services. Therefore, in addition to correcting our own records, we will forward the correction to the data controller (the Customer and/or Reseller). Note that your right to rectification does not give you the right to change how you answered assessment questions, as doing so would infringe upon the rights of the Customer which contracted our Services to have trustworthy, unaltered answers.

Right to Erasure - You may contact us to request the removal of your Personal Data from our databases. Please note that, in most cases, your information has already been shared with the Customer which has contracted our Services, so your request will be forwarded to the data controller (the Customer and/or Reseller) as well, and subject to their data erasure policies.

Right to Restriction of Processing - If you have submitted Personal Data to us but it has not yet been processed and sent to the data controller (the Customer and/or Reseller), you may request that we not process your information. We encourage you to instead request that your information be erased, to ensure that no processing can occur.

Right to Data Portability - As there is no industry standard for transmitting assessment data, it is challenging for us to provide you with a copy of your information that can be reused elsewhere. However, we respect your right to obtain a copy of your information and will send you an XML-formatted copy of the Personal Data which you provided to us upon request.

All requests to exercise your rights will be addressed without undue delay, and within 30 days. To exercise any of your rights, please contact us at corporate_office@objectivemanagement.com. Please note that we will need to confirm your identity via a two-way email exchange.

B. Choice

As the Data Subject, you have the right to opt out of (a) disclosures of your Personal Data to third parties not identified at the time of collection or subsequently authorized, and (b) uses of your Personal Data for purposes materially different from those disclosed at the time of collection or subsequently authorized.

When OMG is contracted by its Customers to provide assessment services, OMG's Customers are responsible for informing Data Subjects of when they have the right to opt out of such uses or disclosures. Data Subjects who wish to limit the use or disclosure of their Personal Data should submit that request to OMG's Customers that control the use and disclosure of their Personal Data. OMG will cooperate with its Customers' instructions regarding Data Subjects' choices.

This opt-out does not apply to disclosures to service providers who process information on our behalf to help us operate and improve our Services.

  1. How Long Do We Keep Your Information

Where OMG is the data processor, the Customers who contract our assessment services determine the length of time that data will be retained, and OMG will respect and enforce any retention guidelines specified by the respective Customer. In many cases, in the case where the Data Subject is a current employee of the Customer, it is important for the Customer to have access to your assessment data for a period of many years, in order to view or demonstrate how your abilities have changed over a period of time. In the case of candidates for employment for the Customer, a long period of time may pass between an individual completing an assessment and actually being hired, and again that information may need to be compared to establish skill progression over a period of many years.

Where OMG is the data controller, OMG retains Personal Data only for as long as necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.

Where feasible, OMG periodically reviews retained information and deletes or de-identifies Personal Data when it is no longer needed for the purposes for which it was collected.

Please note that you can exercise your rights to remove your personal information from our systems, as described in this Privacy Policy, at any time.

D. Opt-Out

If you tell us that you do not want us to use your Personal Data to contact you, OMG will comply with the applicable law. In certain cases, OMG will only contact you if instructed to do so. In either case, you may instruct OMG to stop sending you emails, newsletters, text messages, or other information. OMG may, however, continue to use your Personal Data to contact you in conjunction with your use of the Services. Please note that if you use more than one name or e-mail address when communicating with OMG or using the Site or Services, you may continue to receive communications from OMG to any name or email address not specified by you in an opt-out request. We will also provide an individual opt-out or opt-in choice before we share your data with third parties other than as specified in this Privacy Policy, or before we use it for a purpose other than as specified in this Privacy Policy. To limit the use and disclosure of your Personal Data, please submit a written request to corporate_office@objectivemanagement.com.

Where you have provided your consent for us to use or process your Personal Data, you can withdraw your consent at any time by emailing us at corporate_office@objectivemanagement.com. Please see the “Cookies” section below for information about withdrawing your consent for cookies. We process your Personal Data for marketing purposes with your consent, and at any time after providing consent, you have the right to object to our processing of data about you in order to send you promotions, special offers, and marketing, and we will stop processing the data for that purpose. This option does not apply to communications primarily for the purpose of contracts, support, software updates, or other administrative and transactional notices.

Under applicable law, certain individuals have access to the Personal Data about them that OMG holds and are able to correct, amend, or delete that information where it is inaccurate or has been processed in violation of the privacy principles. If you would like to modify or delete your Personal Data, please submit a request at corporate_office@objectivemanagement.com with clear instructions about what you would like modified or deleted. We will respond to your request within 30 days after a complete request is received. Please note that we cannot modify all information provided to us, such as anonymized data. We will comply with requests to modify information to the extent that we are able to do so.

We will retain your information for as long as needed to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We may post testimonials on the Site which may contain Personal Data. Prior to posting any testimonial, we obtain consent of the individual (via email) to post their name along with their testimonial. To request removal of your Personal Data from testimonials please contact us by submitting a request at corporate_office@objectivemanagement.com.

8. State-Specific Privacy Rights

OMG acknowledges that under data privacy laws in several states in the United States (including but not limited to California, Colorado, Connecticut, and Virginia), individuals have certain rights associated with their Personal Data and other information. Although OMG may not currently be covered by those state data privacy laws, we assure you that we do not sell information about you, except as contemplated in the event of a sale of OMG or its assets as described herein. OMG does not, at this time, disclose Personal Data to third parties for their direct marketing purposes. If OMG changes this policy, we will update this provision and provide instructions on how you may make a request for details concerning such information.

9. EU-U.S. Data Privacy Framework, UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework

OMG complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. OMG has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. OMG has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

Pursuant to the DPF Program, EU, UK, and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States in reliance on the DPF Program should contact us using the contact information listed above. If requested to remove data, we will respond within a reasonable timeframe. Additionally, we will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To request to limit the use and disclosure of your personal information, please submit a written request to us using the contact information listed above.

In compliance with the Data Privacy Framework Principles, OMG commits to resolve complaints about our collection or use of your personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding our Data Privacy Framework policy should first contact Objective Management Group at the contact information listed above. OMG will respond to DPF Principles-related complaints within 45 days.

OMG has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. Please visit https://www.dataprivacyframework.gov/framework-article/ANNEX-I-introduction for more information on this process.

When OMG receives personal information under the Data Privacy Framework and then transfers it to a third-party service provider acting as an agent on OMG's behalf, OMG has certain liability under the Data Privacy Framework if both (i) the agent processes the information in a manner inconsistent with the Data Privacy Framework and (ii) OMG is responsible for the event giving rise to the damage. With respect to personal data received or transferred pursuant to the Data Privacy Framework, OMG is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission. In certain situations, OMG may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, OMG commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner’s Office (ICO), and the Swiss Federal Data Protection and Information Commissioner (FDPIC), as applicable, with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF. To pursue an unresolved human resources complaint, you should contact the state or national data protection or labor authority in the appropriate jurisdiction listed above. Complaints related to human resources data should not be addressed to the BBB NATIONAL PROGRAMS.

The Federal Trade Commission has jurisdiction over OMG’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

10. Identifying Your Data Controller

For the purposes of data privacy law, including under the EU General Data Protection Regulation 2016/679 (“GDPR”), the data controller is the party that controls how your data is being used. As a contracted assessment provider, OMG is acting as a data processor, not a data controller. In other contexts (such as website inquiries, newsletter sign-ups, and requests for information), OMG may act as a data controller. Since some rights may need to be exercised with the data controller, you have a right to know the identity of the data controller. To obtain the identity of the data controller, please email us at corporate_office@objectivemanagement.com and include the alphanumeric PIN you were provided when starting your assessment (this was also emailed to you in the form of a link).

11. Security

OMG has implemented technical, administrative, and physical security measures to protect your information from unauthorized access and use as described. Some examples of such measures include the use of a secure server, industry-standard encryption in transmit (TLS), and limiting access to authorized personnel who require access for business purposes and who are subject to confidentiality obligations. While OMG strives to protect your information, no data transmission over the Internet is 100% secure, and consequently, we cannot ensure the security of any information.

12. Our Site Is Not For Use By Minors

NOTICE TO CHILDREN UNDER 18 AND THEIR PARENTS OR LEGAL GUARDIANS: THE SITE AND SERVICES ARE INTENDED FOR ADULTS. BY USING THE SITE, YOU HEREBY REPRESENT THAT: (A) YOU ARE NOT UNDER THE AGE OF 13, (B) ARE NOT A MINOR IN THE JURISDICTION IN WHICH YOU RESIDE, OR IF A MINOR, YOU HAVE RECEIVED PARENTAL PERMISSION TO USE THE SITE AND PROVIDE YOUR PERSONAL DATA. We do not knowingly collect any information from anyone under the age of 13. We do not use an application or other mechanism to determine the age of users of the Site. All information provided to OMG will be treated as if an adult provided it. If, however, we learn that a minor has submitted information about himself or herself to us without parental permission, we will delete the information as soon as possible. If you know of anyone under the age of 18 who has provided us with information, please contact us immediately, and we will delete the information.
